Welcome to Bhaj Studios. By booking a session, renting our facilities, or participating in any photography sessions, content creation, or events, you (hereinafter: the “Client” or “Participant”) agree to the following Terms and Conditions, which include a Waiver of Liability Release. Please read them carefully before confirming payment or participating. Access to Bhaj Studios will not be granted without acknowledgement and agreement of this document. If the Participant is under 18, a parent or legal guardian must acknowledge on their behalf.

1. Booking and Payment

  • Session Fees: All session or rental fees are due at the time of booking to secure your appointment. Payments are non-refundable but may be rescheduled subject to the cancellation policy below.

  • Payment Methods: We accept most major credit cards. All payments must be completed before services are rendered or products delivered.

  • Taxes: All charges are subject to applicable taxes (e.g., GST in Alberta), which the Client agrees to pay as and when due.

  • Damage Fees: Clients are responsible for any damages, loss, or theft of equipment or property. Damage fees can range, as reasonably evaluated, and must be paid immediately at the end of the rental period.

2. Cancellation and Rescheduling

  • Cancellations: Cancellations made more than 7 days before the scheduled session receive a full refund. Cancellations within 7 days are non-refundable but may be rescheduled once, subject to availability. Cancellations within 24 hours results in a forfeiture of the session fee.

  • Rescheduling: Rescheduling requests must be made at least 24 hours prior to the session. Repeated rescheduling may incur a fee of $50 CAD.

  • No-Shows: Failure to attend a scheduled session without prior notice results in forfeiture of the session fee

  • Extenuating Circumstances: In cases of documented emergencies (e.g., medical emergencies, bereavement), a partial refund or full credit for a future session may be offered at our sole discretion.

3. Session and Rental Details

  • Session Duration: Sessions and rentals are booked for a specific duration, as outlined in your agreement. Additional time may be available but must be booked online through our calendar.

  • Client Responsibilities: Clients must arrive on time, prepared, and dressed as discussed. Delays may reduce session time without refund.

  • Location: For on-location shoots, Clients are responsible for securing necessary permits or permissions unless otherwise agreed.

  • Minors: For sessions involving minors, a parent or legal guardian must always be present.

  • Guests: Clients are responsible for their guests, with a limit of 10 guests (including vendors) per booking. Larger parties require pre-approval. Bhaj Studios is not liable for injuries or accidents incurred by Clients or their guests.

  • Studio Condition: Clients accept the studio in its existing condition and agree to return it in the same state of repair and cleanliness, normal wear and tear excepted. Clients must not allow refuse, garbage, or objectionable materials to accumulate and are responsible for any cleaning or repair costs.

4. Studio Rules and Equipment Use

  • General Conduct: Clients must behave respectfully toward staff and other participants. Bhaj Studios reserves the right to terminate a session or rental without refund if behavior is deemed unsafe, inappropriate, or disruptive.

  • Equipment Use: Clients represent they are capable of safely operating and handling all equipment (e.g., photo boards, furniture, props, planters) and agree to return it in good working order. Clients bear all risk and responsibility for damages, loss, or theft of equipment and shall pay damage fees upon request.

  • Restricted Actions:

    • Select furniture and planters cannot be moved without permission and assistance from Bhaj Studios. Unauthorized movement may incur damage fees.

    • No food or drink (except water) is allowed in studio rooms; all must remain in pre-approved common areas.

    • Kitchen use for cooking or catering requires separate rental and pre-approval.

    • Clients may not affix anything to walls, make alterations, operate large business machines, use flammable materials, or display signage without prior written consent.

    • Smoking is prohibited in the studio

    • No animals are allowed without prior written consent.

    • Corridor doors, exit doors, or connecting corridors must not be propped open after business hours.

  • Permitted Use: Use is limited to photography sessions and content creation. Content that is violent, racist, discriminatory, harassing, nude, pornographic, or otherwise inappropriate is strictly forbidden. Bhaj Studios may terminate use without refund for non-compliance.

5. Cleaning and Maintenance

  • Client Responsibility: All setup and cleaning must be completed within the rental period. Clients must return all equipment, props, and furniture to their original condition and location. For furniture requiring Company assistance to move, Clients must request assistance to return it no later than 10 minutes before the rental period ends.

  • Cleaning Fees: A $100 CAD cleaning fee will be charged if the space is not returned in its original condition, payable at the end of the booking.

  • Special Decorations: An additional hour for cleaning is required if Clients bring decorative items like confetti, fake snow, feathers, or glitter. Sparklers and smoke bombs are prohibited.

6. Usage Rights and Copyright

  • Copyright: Bhaj Studios retains full copyright of all images produced, per applicable copyright laws.

  • Personal Use License: Clients receive a non-exclusive, non-transferable license to use delivered images for personal, non-commercial purposes (e.g., personal social media, home display prints). Commercial use requires prior written consent and may incur licensing fees.

  • Photographer’s Rights: Bhaj Studios reserves the right to use images for promotional purposes (e.g., website, social media, marketing materials) unless a separate agreement opts out of the model release.

  • Model Release: By booking, Clients grant permission for promotional use of images unless otherwise agreed in writing.

7. Liability and Risk Acknowledgment

  • Recognition of Risk: Clients acknowledge that use of Bhaj Studios, its equipment, and associated activities involves inherent risks of injury to persons or property. Clients assume all such risks and are responsible for taking precautions to minimize them. Bhaj Studios makes no representations regarding the safety of its facilities or activities.

  • Limitation of Liability: Bhaj Studios, its owners, agents, employees, and contractors are not liable for any loss, damage, or injury during a session or rental, except in cases of gross negligence. Clients assume responsibility for their safety and property.

  • Equipment and Data: Bhaj Studios is not liable for data loss due to technical failures. Clients are responsible for maintaining backups of delivered images.

  • Release and Indemnity: Clients release and hold harmless Bhaj Studios, its owners, agents, employees, and contractors from all claims, losses, damages, or expenses (including legal fees) related to the studio, services, or client actions/negligence. Clients shall indemnify Bhaj Studios for liabilities arising from: (1) breach of this agreement; (2) acts or omissions by Clients or their guests; or (3) damage to the studio or equipment caused by Clients or their invitees. This indemnity survives termination of this agreement.

  • Independent Contractors: Any use of independent contractors (e.g., photographers, event planners) is independent of Bhaj Studios and subject to these terms.

  • Force Majeure: Bhaj Studios is not liable for delays or cancellations due to circumstances beyond our control (e.g., weather, illness, emergencies). We will work to reschedule or provide a refund at our discretion.

8. Dispute Resolution

  • Negotiation: Disputes will be addressed through good-faith negotiation. If unresolved, disputes will be handled per the laws of the Province of Alberta.

  • Governing Law: This agreement is governed by the laws of the Province of Alberta, with legal proceedings in Calgary, Alberta.

9. General Provisions

  • Entire Agreement: This agreement constitutes the entire understanding between Bhaj Studios and the Client. Any prior or supplementary agreements are void unless attached in writing.

  • Amendments: Amendments require a written document signed by both parties.

  • Severability: If any provision is deemed invalid, the remaining provisions remain in full force.

  • Waiver: No delay in exercising rights constitutes a waiver. Waivers must be in writing and apply only to specific circumstances.

  • Good Faith: Both parties agree to act reasonably and in good faith.

  • Currency: All amounts are in Canadian Dollars (CAD).

10. Acknowledgment

By confirming your payment and agreeing to this contract, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions, including the Waiver of Liability Release. You confirm that you are voluntarily relinquishing certain future legal rights, free from any duress, inducement, or guarantee.
